Since its inception in 2010, the Network for Public Health Law has aligned with federal, state, tribal, and local public health practitioners to assess how law can promote and protect the public’s health. In 2013, Network authors illustrated major trends in public health laws and policies emanating from an internal assessment of thousands of requests for technical assistance nationally. More recently, the Robert Wood Johnson Foundation has invited the Network and other partners to consider new ideas and strategies toward building (...) a “culture of health.” Per Figure 1, RWJF’s conception of a culture of health emphasizes key action areas essential to the promotion of health across all sectors and diverse populations. The possibility of using private military and security companies to bolster the capacity to undertake intervention for human rights purposes has been increasingly debated. The focus of such discussions has, however, largely been on practical issues and the contingent problems posed by private force. By contrast, this article considers the principled case for privatising humanitarian intervention. It focuses on two central issues. First, does outsourcing humanitarian intervention to private military and security companies pose some fundamental, deeper problems in this context, (...) such as an abdication of a state's duties? Second, on the other hand, is there a case for preferring these firms to other, state-based agents of humanitarian intervention? For instance, given a state's duties to their own military personnel, should the use of private military and security contractors be preferred to regular soldiers for humanitarian intervention? Abstract:Sustainable development and built heritage are oft-naturalized hegemonic discourses of the dominant social class. However, under the lens of critical sociomateriality, these categories destabilize—and in Brexit-era London, epicenter of a financial and technological capitalist circulatory space, “all that is solid melts” into the scopal regime of London's View Management Framework (LVMF). Analyzing multiple discourses of Southwark's Strata SE1— billed London's first “sustainable tower”—and adaptive reuse of the historically preserved Lambeth Water Tower, I argue that these structures constitute ‘interface objects’ in (...) a broader relational geography imbricating physical material, social objects, gentrification and the naturalized epistemologies of hegemonic development within London's skyline itself. I offer a reading of critical sociomateriality which illuminates rhythms of daily life within spatial-technological systems of energy provision, urban metabolic processes, as well as “hegemonic premiums,” what Richard Barras terms expected return on symbolic capital vis-à-vis the dominant panopticism of the LVMF. This paper contributes a theorization of critical sociomateriality, operating across a diversity of scales, tactics, and disciplines, analyzing discourses and practices which insinuate politics, artifacts, and technologies across contested issues. Critical sociomateriality is presented as a methodology for deconstructing tactics for inhabiting and interfacing with ‘sustainability’ through London's skyline in an unequal capitalist system marked by dissensus over runaway development, social precarity, and inequality in lived experiences of the urban environment. One of the most controversial issues to face any industry has been the infant formula problem, especially in the less-developed countries (LDCs). Producers of infant formula were confronted with a boycott which evolved from a grass-roots level to one which involved many nations, international and national public agencies, non-profit organizations, scientific research institutions, large church denominations, and every company in the industry. An international boycott was aimed at Nestlé, one of the largest producers of infant formula.The aim of this paper (...) is (1) to examine both sides of the controversy, and (2) to analyze the results of the boycott, specifically the introduction of product codes and changes in industry and company strategies. Self-interest has long been recognized as a powerful human motive. Yet, much remains to be understood about the thinking behind self-interested pursuits. Drawing from multiple literatures, we propose that situations high in opportunity for self-interested gain trigger a type of moral cognition called moral disengagement that allows the individual to more easily disengage internalized moral standards. We also theorize two countervailing forces—situational harm to others and dispositional conscientiousness—that may weaken the effects of personal gain on morally disengaged reasoning. We test (...) our hypotheses in two studies using qualitative and quantitative data and complementary research methods and design. We demonstrate that when personal gain incentives are relatively moderate, reminders of harm to others can reduce the likelihood that employees will morally disengage. Furthermore, when strong personal gain incentives are present in a situation, highly conscientious individuals are less apt than their counterparts to engage in morally disengaged reasoning. As health policy-makers around the world seek to make progress towards universal health coverage, they must navigate between two important ethical imperatives: to set national spending priorities fairly and efficiently; and to safeguard the right to health. These imperatives can conflict, leading some to conclude that rights-based approaches present a disruptive influence on health policy, hindering states’ efforts to set priorities fairly and efficiently. Here, we challenge this perception. We argue first that these points of tension stem largely from inadequate (...) interpretations of the aims of priority setting as well as the right to health. We then discuss various ways in which the right to health complements traditional concerns of priority setting and vice versa. Finally, we set out a three-step process by which policy-makers may navigate the ethical and legal considerations at play. (shrink)

The authors assess the collaboration between the University of California, Berkeley’s Community Assessment of Renewable Energy and Sustainability program and the Pinoleville Pomo Nation, a small Native American tribal nation in northern California. The collaboration focused on creating culturally inspired, environmentally sustainable housing for tribal citizens using a codesign methodology developed at the university. The housing design process is evaluated in terms of both its contribution to Native American “cultural sovereignty,” as elaborated by Coffey and Tsosie, and as a potential (...) example of the democratization of scientific practice. In two papers in the previous issue of the Kennedy Institute of Ethics Journal, I contend that the form of principlist fundamentalism endorsed by American bioethicists like Tom Beauchamp and Ruth Macklin will not play on an international stage. Deploying (...) techniques of postmodern scholarship, I argue that principlist fundamentalism justifies neither the condemnation of the Nazi doctors at Nuremberg, nor, as the Report of the Advisory Committee on the Human Radiation Experiments (ACHRE) demonstrates, condemnation of Cold War radiation researchers. Principlist fundamentalism thus appears to be philosophically bankrupt. In this issue of the Journal, Beauchamp and Macklin reject this claim, arguing that I have misread the ACHRE report and misunderstood Nazism. They also argue that the form of post-postmodern negotiated human rights theory that I proffer is adequate only insofar as it is itself really fundamentalist; insofar as I take postmodernism seriously, however, I mire international bioethics in relativism. In this response, I reaffirm my anti-fundamentalism, provide further evidence in support of my reading of the ACHRE report, and defend my post-postmodern version of rights theory. I also develop criteria for a minimally adequate theoretical framework for international bioethics.Universal Morality Reconsidered 1Paradoxically, the need for content-full universal moral principles tends to be most deeply felt and most adamantly asserted in the face of striking evidence of their absence. People are inspired to claim that Nazis must accept the universal principle that doing harm is wrong because they are appalled by the horror of the Holocaust. Yet the event itself provides palpable evidence that the Nazis saw no wrong in doing harm. One has the suspicion that claims of universalism [End Page 423] confound philosophical aspirations with empirical observations. This distinction makes a significant difference because empirical claims can be disconfirmed by data, whereas philosophical claims can only be challenged on the level of theory.I am, like Tom Beauchamp and James Childress, a common morality theorist. Thus, I believe, as they do, that ethics “relies heavily on ordinary shared moral beliefs for its content, rather than relying on pure reason, natural law, a special moral sense, and the like” (Beauchamp and Childress 1994, p. 100). For most of human history sexism and slavery were considered moral. They certainly were the norm. Thus, if one looks to common morality as the source of moral content, empirical claims of moral universalism appear suspect. Insofar as one would condemn sexism and slavery, one needs to find some theoretical justification for condemnation that goes beyond a consensus on moral content (hence my embrace of the structural analogue of human rights theory).Beauchamp, however, takes a very different view. He asserts in his critique of my position, that: “it is an institutional fact about the substance of morality (not merely [as Baker claims] the formal features of the concept of morality and not merely my view of it) that it contains fundamental and shared precepts. It is by appeal to this shared moral substance that persons are enabled to make justifiable cross-temporal and cross-cultural judgments” (Beauchamp 1998, p. 395). Beauchamp is thus claiming that it is both an empirical and a conceptual truth there is common core underlying the morality of all societies. He fleshes this claim out in another passage.[T]he term morality refers to norms about right and wrong human conduct that are so widely shared that they form a stable... communal consensus.... These standards sometimes vary from society to society, but embedded in the beliefs of all moral societies are the core dimensions of morality: Persons must keep their promises, must respect the rights of others, must not kill or cause harm to innocent persons, must not abuse children, and the like. Tom Beauchamp and James Childress‘s revolutionary textbook, Principles of Biomedical Ethics, shaped the field of bioethics in America and around the world. Midway through the Principle’s eight editions, however, the authors jettisoned their attempt to justify the four principles of bioethics —autonomy, beneficence, nonmaleficence, justice—in terms of ethical theory, replacing it with the idea that these principles are part of a common morality shared by all rational persons committed to morality, at all times, and in all places. Other commentators (...) contend that their theory has never been empirically confirmed and is unfalsifiable, since counterexamples can be deemed irrational, or as held by those living lives not committed to morality. The thesis of this paper is that common morality theory is the artifact of a category mistake—conflating common areas regulated by moral norms with common norms regulating moral conduct—that accords mid-twentieth century American liberal morality the status of transcultural, transtemporal, eternal moral truths. Such a conception offers bioethicists no tools for analyzing moral change—moral progress, regress, reform, evolution, devolution, or revolution—no theoretical basis for deconstructing structural classicism, racism, and sexism, or for facilitating international cooperation on ethical issues in the context of culturally based moral differences. I don’t think Lynne Rudder Baker’s constitution view can account for personal identity problems of a synchronic or diachronic nature. As such, it cannot accommodate the Christian’s claim of eschatological bodily resurrection-a principle reason for which she gives this account. In light of this, I press objections against her constitution view in the following ways: First, I critique an analogy she draws between Aristotle’s “accidental sameness” and constitution. Second, I address three problems for Baker’s constitution view [‘Constitution Problems’ (...) ], each more problematic than the next: CP1: Her definition of constitution lacks explanatory power; CP2: If there is a plausible definition of constitution, constitution implies either too many persons or no human persons at all; CP3: Constitution yields no essential distinction between human and divine persons. If my argument go through, her constitution view has neither an explanation for diachronic personal identity nor personal identity through resurrection. (shrink)

Baker, James and Reader offer new religious engagement with the public sphere via means of interdisciplinary analysis and empirical examples, developing what we call a Relational Christian Realism building upon interaction with contemporary Philosophy of Religion. This book represents an exciting contribution to philosophy and practice of religion on both sides of the Atlantic and aspires to be sufficiently interdisciplinary to also appeal to readerships engaged in the study of modern political and social trends.

The history of American medical ethics is a notoriously unwieldy field that encompasses an enormous amount of complex material. No single book can realistically analyze all of its dimensions in a genuinely scholarly fashion. But Robert Baker, one of the nation’s most distinguished professors in that field, has now provided the rest of us with an immensely helpful survey of one of its most important aspects: the evolution of what he terms “the formalized statements of medical morality” (164). If we are to assess whether our attitudes towards nature are morally, aesthetically or in any other way appropriate or inappropriate, then we will need to know what those attitudes are. Drawing on the works of Katie McShane, Alan Holland and Christine Swanton, I challenge the common assumption that to love, respect, honour, cherish or adopt any other sort of pro-attitude towards any natural X simply is to value X in some way and to some degree. Depending on how one (...) interprets ‘value’, that assumption is, I contend, either false or vacuous. I argue that to assess the appropriateness of a person’s pro-attitudes towards a natural entity one must in some cases appeal to the concepts of status and/or bond, and not just that of value. It performs the same function, Daniel Gordon argues in his introduction to Postmodernism and the Enlightenment, that the Ancien Regime did for the French revolutionaries: as the "other of postmodernism," it represents "the modern that postmodernism revolts against" (P&E, p. 1). Indeed, the image of the Enlightenment that emerges from the postmodern critique does seem, in large part, to be an invention. As Keith Michael Baker and Peter Hanns Reill suggest in the introduction to their collection What's Left of Enlightenment? the various strands of thought commonly grouped under the label postmodernism "have at least one thing in common": "they all depend upon a stereotyped, even caricatural, account of the Enlightenment" which sees the Enlightenment as the point of origin for the "rationalism, instrumentalism, scientism, logocentrism, universalism, abstract rights, eurocentrism, individualism, humanism, masculinism, etc." that [End Page 432] defines the modernity which postmodernity hopes to supersede (WLE? p. 1).One consequence of the inclination to trace the origin of the various failings of modernity to the Enlightenment is that arguments about the "legacy of the Enlightenment" tend to get out of hand. In a particularly sharp-sighted contribution to the Baker and Reill collection David Hollinger notes that it is all too easy for a critic of Enlightenment to argue that "I'm hot stuff because I'm not only refuting you, my puny opponent, but... every great thinker from Descartes to Popper," and, conversely, all too enticing for those who have been criticized to counter, "watch out, you think you are arguing only against me, but the implications of your reasoning are to deny the common sense of every humane and rational mind since the seventeenth century" (WLE? p. 9). Historians of the eighteenth century have been curiously reluctant to join this battle and have, for the most part, left the field to philosophers, literary scholars, and political theorists (WLE? pp. 17-18; P&E, p. 3). The intent of the two collections reviewed here is to remedy this situation by setting a group of historians to work scrutinizing differing aspects of the postmodernist critique of the Enlightenment. More often than not, the results are quite rewarding, though the question of the relationship between postmodernism and the Enlightenment remains, in the end, somewhat ambiguous.The scope of these two volumes is quite impressive. Baker and Reill's collection opens with essays by David Hollinger and Richard Rorty (one of the two nonhistorians invited to the festivities) offering contrasting characterizations of the relationship of postmodernism and the Enlightenment. It continues with a discussion of a few important interpretations of the Enlightenment (including articles by Jonathan Knudsen on German historicism, Hans Sluga on Heidegger, Johnson Kent Wright on Cassirer, and Michael Meranze on Foucault) and concludes with essays by Lorraine Daston ("Enlightenment Fears, Fears of Enlightenment"), Dena Goodman (on gender difference in the Enlightenment), and Lawrence Klein (on the idea of "conversation" in the Enlightenment) that seek, in differing ways, to reveal "the existence within the Enlightenment of elements frequently seen as characteristic of Postmodernity itself" (WLE? p. 3).Gordon's volume offers a counterpoint to the final part of Baker and Reill's collection: each of its nine essays is intended as confrontation between a postmodernist characterization of a particular aspect of the Enlightenment and an account of "how the theme really operates in [End Page 433] Enlightenment thought" (P&E, p. 5). After reconstructing three arguments for Nietzsche’s descriptive analysis of the self as complex, this article clarifies some of greatness’s psychological conditions. It then offers three arguments for why we should not focus on these internal conditions when seeking to verify or to achieve greatness. First, Nietzsche’s descriptive analysis of the self renders introspection too coarse-grained and error-prone to verify the subtle type of unity required for greatness. Second, Nietzsche associates introspective appraisal of one’s psyche with a moral project that weakens (...) and represses the drives, such that inquiry into whether greatness’s internal conditions are satisfied typically speaks against their realization. Finally, the actions characteristic of Nietzsche’s great individuals prohibit introspective preoccupation with oneself. These arguments suggest that we should attend to outwardly directed accomplishments, rather than psychology, when appraising the greatness of others and seeking to become great ourselves. (shrink)

Hardback, $37.00.Paul Sagar's invigorating book is a reconsideration of Adam Smith in the sense that it challenges much that is received wisdom in current scholarship. First and foremost, it rejects (...) the idea that Smith was preeminently a moral philosopher concerned with the threat to civic virtue posed by commercial society, and yet intent on giving commercial society a moral vindication nevertheless. Sagar—rightly, in my view—wants us to recognize Smith as having been a political thinker. Too much work on Smith still assumes that there is not much to say [End Page 323] about his political thought because he regarded all but the most minimal government as an obstacle to the proper functioning of markets. Smith is supposed to be a "classical liberal" bent on preserving as much natural liberty as possible in the face of government's relentless overextension of its powers of regulation. In Adam Smith's Politics: An Essay in Historiographic Revision (Cambridge: Cambridge University Press, 1978), Donald Winch rejected that approach to Smith in favor of a portrait of the author of The Theory of Moral Sentiments and The Wealth of Nations as an eighteenth-century thinker with an eighteenth-century thinker's concerns. Sagar's project is quite different. This is a book on Smith's political thought that does not once deploy the term 'Whig.' Sagar's Smith does not wholly float free of his historical situation—the questions he addresses are those posed by the end of feudalism and the advent of modernity—but situating him in the particular circumstances of Britain in the age of revolutions is not Sagar's concern. As Sagar sees it, the fundamental issues addressed by Smith's political thought concern the distinctive form taken by commercial society in the modern era. Smith, according to Sagar, held that all advanced societies are commercial societies. Commercial society as such needed no vindication. The question, rather, was what kind of commercial society a modern state wanted to be. That was a political question insofar as it was a question about the kind of freedom that mattered and about the kind of institutions needed to make that freedom a reality.Defined in maximally general terms, freedom for Smith was the absence of domination, where domination is understood as a lack of security in respect of one's physical safety and possessions. The condition of the poor and powerless had always been one of subjection to the will of the rich and powerful. What changed that, according to Smith, was implementation of the rule of law. This is in itself not a new reading of Smith, but what distinguishes Sagar's version of it is the care with which he examines both the place of the rule of law in Smith's historical account of the emergence of liberty in modern Europe and the precise nature of the connection between the rule of law and freedom. First, on Sagar's view, there needed to be a comprehensive picture of domination and slavery, which had been the normal condition of almost everyone for almost all of human history. Then there needed to be an explanation of how it was that, at one particular historical moment, domination was slowly but surely challenged by the emergence of law and law courts considered as independent of political power. In England, this was the story of the common law and of judges who held office for life, rather than at the pleasure of traditional possessors of power. It was the story of security in property, of the backing of property by law, and it was a largely urban story, of burghers who managed to enlist monarchs on their side in the battle against the barons. It was, in other words, in large part a medieval story, and one consequence is that there was more to say about the rise of liberty in the modern age than that it was caused inadvertently by... This paper provides a critical reconstruction of J. B. Erhard's account of recognition that locates it within the context of his revolutionary natural law theory. The first three sections lay out the foundations of Erhard's position. The fourth section outlines Erhard's response to the opponents of revolution and raises a problem for it. The fifth section argues that we can resolve this problem by drawing upon Erhard's account of failures of legal recognition. Applications of artificial intelligence/machine learning in health care are dynamic and rapidly growing. One strategy for anticipating and addressing ethical challenges related to AI/ml for health care is patient and public involvement in the design of those technologies – often referred to as ‘co-design’. Co-design has a diverse intellectual and practical history, however, and has been conceptualized in many different ways. Moreover, AI/ml introduces challenges to co-design that are often underappreciated. Informed by perspectives from critical data studies and critical digital (...) health studies, we review the research literature on involvement in health care, and involvement in design, and examine the extent to which co-design as commonly conceptualized is capable of addressing the range of normative issues raised by AI/ml for health care. We suggest that AI/ml technologies have amplified and modified existing challenges related to patient and public involvement, and created entirely new challenges. We outline three pitfalls associated with co-design for ethical AI/ml for health care and conclude with suggestions for addressing these practical and conceptual challenges. (shrink)

We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)
